Privacy Policy (for customers who use the support office reserved for overseas users)

POLICY FOR PROTECTION OF
PERSONAL INFORMATION

YA-MAN Ltd. (hereinafter referred to as the “Company”) conducts business activities that mainly consist of research and development, manufacturing, import, export, and sales of beauty and health equipment. The Company stipulates this policy for the protection of personal information received from companies, individuals, and the Company’s employees for corporate activities and accomplishing the mission of social contribution, and will strictly fulfill its responsibilities for management of such personal information.

THE COMPANY’S POLICY

  1. In some cases, the Company will clarify the purpose of use of personal information for performing work, and then obtain by appropriate methods, possess, manage and use the personal information of its customers or employees. The Company will use personal information within the scope of the purpose of use as stated below and take appropriate measures to prevent using for other purpose.
  2. The Company will comply with laws, regulations, guidelines and other standards related to handling of personal information. In addition, in the event that the Company consigns a part or all of personal information, the Company will select a company or a party that fulfills management standards, conclude contracts with them, and implement appropriate measures and management of personal information.
  3. The Company’s personal information management system conforms with Japan Industrial Standard JIS Q15001-2006.
  4. The Company will implement sufficient and safe preventive management and measures against dangerous situations, such as unauthorized access to personal information, as well as data loss, alteration, leaks, and destruction of personal information, and will implement corrective measures.
  5. The Company will reply to requests for disclosure, correction, deletion, suspension of use, and changes of personal information that are made by the person who provided the personal information. The Company will also establish a consultation office for complaints and consultations about management of personal information and will sincerely and promptly handle matters for which replies should be made.
  6. The Company will continuously reconsider the Company’s personal information management system and improve it.

HANDLING OF PERSONAL INFORMATION

1. Scope of use and purposes of use

The purposes of the Company’s use of personal information will be as stated below.

Information about customers who use services (hereinafter referred to as the “Services”) of the support office reserved for overseas users on the Company’s website.
For sending products that are subject to support and for providing other Services.
For handling customers’ inquiries related to the Company’s products and the Company’s services, and for providing customers with information about the Company’s products and the Company’s services.
For sending samples, prizes, campaign products, promotional gifts, catalogs, direct mail, informational magazines, and announcement.
For data analysis for the improvement of the Company’s products and services and marketing.
For providing customers’ information to parties consigned with delivery of products, parties consigned with repair work for products, parties consigned with work for settlement services for repair charges, parties consigned with data analysis work, other parties to which the Company has consigned work, or parties that have been re-consigned by a party that has been consigned with work.
Parties to which the Company may consign work include companies that conduct business in any countries other than Japan, as well as companies that conduct business in Japan.

Information related to people who have made a request for the disclosure related to personal information for appropriately handling requests.

Information related to people who have made an inquiry or complaint related to personal information for appropriately handling inquiries and complaints.

2. Types of information that the Company will obtain

(1) Information that the Company will obtain automatically

When customers use the Services, the Company will automatically obtain and use the information stated below,
for the purposes of use stated in item 1.
Information related to terminals and networks that were used for use of the Services (terminal identification ID, provider, carrier, etc.) and information related to the state of use and connection (date and time of use, operation history, access history, etc.)

(2) Information that the Company will obtain from customers

In addition to item (1), when customers use the Services, the Company will obtain from customers and use the information stated below, for the purposes of use stated in item 1.

  2. Address
  3. Telephone number
  4. E-mail address
  5. Age
  6. Gender
  7. Credit card information
  8. Bank account information
  9. History of purchasing and using the Company’s products and the Company’s services
  10. Other information that is necessary for the Company to provide the Services

(3) If a customer is younger than 13 years old, it is necessary for him or her to obtain the agreement of a person with parental authority or a guardian before providing personal information to the Company.

3.Provision of personal information to third parties

Excluding cases in which customers’ information will be provided to the Company’s parties consigned with work by the Company, the Company will not provide customers’ personal information to third parties without obtaining the customers’ consent. Provided, however, that the cases stated below are excluded.

Cases in which the provision of personal information is based on laws and regulations.
Cases in which the provision of personal information is necessary for the protection of the life, body, or property of an individual and in which it is difficult to obtain the consent of the person.
Cases in which the provision of personal information is specially necessary for improving public health or promoting the sound growth of children and in which it is difficult to obtain the consent of the person.
Cases in which the provision of personal information is necessary for cooperating with a state organ, a local government, or an individual or a business operator entrusted by one in executing the affairs prescribed by laws and regulations and in which obtaining the consent of the person are likely to impede the execution of the affairs.
Other cases in which the provision of personal information to a third party is permitted based on applicable laws and regulations.

4.Matters related to procedures for handling requests for the disclosure

The Company will handle, according to the provisions of laws and regulations related to handling of personal information, requests for disclosure of personal information, notification of purposes of use, correction, addition, or deletion of personal information, or suspension of use or elimination of personal information that are made by the person who provided the relevant personal information.

(1) Place for making requests for the disclosure etc. of personal information

Please make requests for the disclosure of personal information directly to the Company’s office for consultations about personal information (hereinafter referred to as the “Consultation Office”).

(2) Document to be submitted when making a request for the disclosure etc. of personal information

Please enter the requirement including the requested matter (disclosure of personal information, notification of purposes of use, correction, addition, or deletion of personal information, or personal information’s suspension of use, elimination, or suspension of provision to third parties) in a “Written Request for Disclosure of Personal Information” and then apply by sending it to the Consultation Office by postal mail.

(3) Service charges that will be necessary for requesting the disclosure of personal information

For disclosure of personal information or notification of purposes of use, for each case of a request, (i) ¥1,200, if a reply by email has been designated or (ii) ¥2,400, if a reply by sending a document has been designated, will be collected separately as services charge. When you send a written request for disclosure or a written request for notification of purposes of use by postal mail, please pay the service charges according to the Company’s designated method.

(4) People who can request the disclosure etc. of personal information

The people who can request the disclosure etc. of personal information will be as stated below.

  1. The person to which the personal information belongs (the person who is identified by the personal information that will be subject to disclosure, etc.)
  2. A representative (a person who has been delegated by the person to whom the information belongs, or a legal representative, such as a person who has parental authority)

(5) Documents for confirmation of the identity of the person to which the personal information belongs or his or her representative

When a request is made for the disclosure etc. of personal information, we will have the person making the request submit a document for the purpose of confirmation of the fact that he or she is the person to whom the information belongs or is that person’s representative.

  1. If the person making a request for the disclosure etc. of personal information is the person to whom the information belongs
    Any one of the matters below
    A copy of the person’s passport, driver’s license, or an identification certificate that is equivalent to one of these (information by which it is possible to confirm the person’s name, address, and birthdate)
  2. If the person making a request for the disclosure of personal information is a representative
    Any one of the documents of “i" above, and a letter of authorization by the person to whom the information belongs (We request that the person to whom the information belongs sign his or her name on the letter of authorization and submit a certificate of his or her signature. If the representative is a legal representative, such as a person with parental authority, instead of a letter of authorization please submit an official document that proves the relationship with the person to whom the information belongs.)

(6) Replies

For requests for the disclosure etc. of personal information, after confirming the person’s identity (in a case of a request by a representative, after confirming the authority for representation), we will reply by sending a document to the address of the person to whom the information belongs (in a case of a request by a representative, the representative) or reply by sending an e-mail to the e-mail address that was designated by the person who made the request. Please note that we will not conduct the disclosure etc. in the cases below.

  1. Cases in which payment of service charges was not confirmed
  2. Cases in which the identity of the person to whom the information belongs or the authority for representation was not confirmed
  3. Cases in which disclosure etc. is likely to harm the life, body, property, or other rights or interests of the person or a third party
  4. Cases in which disclosure etc. is likely to seriously impede the proper execution of the business of the business operator handling personal information
  5. Cases in which disclosure etc. violates other laws and regulations
  6. In addition to the above, cases in which the Act on the Protection of Personal Information stipulates that the disclosure are not necessary

(7) Handling for requests for the disclosure etc. of personal information

Requests for the disclosure etc. of personal information will be made in writing, and replies for requests will be made in writing or e-mail. In addition, the language that will be used will be Japanese or English.

5.Internal system, and policy for operating the management system

The Company will establish an organization to operate a personal information management system and then establish a personal information protection manager and prepare and maintain a system for protecting personal information. The Company’s personal information protection manager is the director of Management Headquarters. For the personal information protection management system, the Company will conduct reconsideration in a timely and appropriate manner based on changes of the environment surrounding the Company and will continuously move forward with improvements for the system.

7.Changes

If the Company has judged that it is necessary, this privacy policy may be changed. If a change has been made, the changed privacy policy will be promptly posted on the Company’s website, and the changed privacy policy will go into effect at the time of posting. A customer who has used the Services after the changed privacy policy went into effect will be deemed to have agreed to the changed privacy policy.
